Abstract
Makalede Şafii fukahasından Firkah adıyla tanınan Tacuddîn el-Fezarî'nin ganimet paylaşımına dair olan er-Ruhsatu'l-amime fî ahkami'l-ganîme adlı eseri tercüme edilmiş ve ileri sürdüğü görüş, Nevevî'nin reddiye olarak kaleme aldığı Mes'eletu vücûbi tahmîsi'l-ganîme adlı risalesindeki cevapları da dikkate alınarak değerlendirilmiştir. Firkah, bu risalesinde savaş sonucunda elde edilen ganimeti taksim etme yetkisinin devlet başkanına ait olduğunu ve onun ganimet üzerinde, maslahatın gerektirdiği şekilde dilediği gibi tasarruf edebileceğini savunmuş ve bu görüşünü Hz. Peygamber ve dört halife dönemi uygulamaları ile delillendirmiştir. Her ne kadar işlediği konu itibarıyla aktüel bir değeri bulunmasa da bir ictihad denemesi sayılabilecek olan bu risale, nassların yorumu, maslahat, icma vb. fıkıh usulü konuları ile sıkı ilişkisi bulunması itibarıyla önem arzetmektedir.

Abstract
In this article we first have translated the work named "al-Rukhsah al-'Amimah fi ahkami al-ganimah" written by Taj al-din al-Fazari known as “al-Firkah”, al-Shafi'i fiqh scholar. The author in his work dwelled on the provisions of booty and defended the opinion that the president is authorized to make the spoils shared or to use it in accordance with affairs. He tried to prove his opinion with the applications of the Prophet and the four caliphs. al-Nawawi wrote in refutation of this opinion his work named "Mas'alatu vucubi takhmisi al-ganima" and accused al-Firkah of being opposed to ijma (concensus of Moslem scholars). İn this article we compared the two opinions with the proofs. Although the subject matter has'nt an actual value at the present time this work is important because of beeing related to the matters of Usoul al-fiqh such as ijtihad and interpretation of religious texts and ijma and so on.
