Abstract
Müçtehitte bulunması gereken şartlar, diğer bir ifadesiyle, içtihat şartları, ortak noktaları olmakla birlikte muhteliftir. İçtihat şartları usulcüden usulcüye göre değişmektedir. İçtihat şartlarından kimi ağır, kimi hafiftir; kimi az, kimi çoktur. Müçtehidi tespit etmek için bir kurum ve sistem henüz yoktur. Bu bakımdan müçtehidi tespit zordur. Ancak bir sisteme bağlanırsa, imkansız da değildir. Bu çalışma bu hususları delileriyle tespit etmeye yöneliktir.

Abstract
The conditions must be present ın mujtahid, in other words, the conditions of ijtihad, although have common points are different. Terms and conditions are vary according to methodologists of Islamic law. Precedent conditions, some severe, sometimes mild, sometimes less, sometimes many. Restorer of an institution and a system to detect are not available. In this respect, it is difficult determined mujtahid. However, if it is connected the system, is not impossible. This study is intended for fixation these issues with documents.
